Terms & Conditions
Last updated: 3 October 2026
Welcome to eShopFoundry.
These Terms & Conditions ("Terms") govern your use of the eShopFoundry website and, where applicable, your participation in the eShopFoundry beta program.
By using the website or participating in the beta, you agree to these Terms.
1. About eShopFoundry
eShopFoundry is currently a project in development and is operating a limited beta program.
eShopFoundry has not yet been incorporated as a separate legal entity.
The website currently provides information about the project and allows users to register their interest in participating in the beta.
2. Beta Access
Joining the waiting list does not guarantee access to the eShopFoundry beta.
Beta access may be provided at our discretion and may be limited by availability, technical capacity or other factors.
We may invite users to participate in the beta at different times.
We may also modify, suspend or discontinue the beta at any time.
3. Free Beta
The current eShopFoundry beta is provided free of charge.
Participation in the beta is voluntary and does not entitle beta testers to any payment, compensation, reimbursement, reward or other financial benefit from eShopFoundry.
By participating in the beta, you acknowledge and agree that you are testing the service voluntarily and without monetary compensation.
No purchase or subscription is created by submitting your email address through the "Notify Me" form.
Any paid plans, subscriptions or commercial services introduced in the future will be governed by separate or updated terms and will be presented to users before payment is required.
4. Experimental Nature of the Beta
The eShopFoundry beta is provided for testing and development purposes.
Features may be incomplete, modified, temporarily unavailable or removed.
The beta may contain bugs, errors or other technical issues.
We encourage beta users to report problems and provide feedback so that we can improve the product.
5. User Responsibilities
You agree to use eShopFoundry only for lawful purposes.
You must not:
- use the service for illegal activities;
- attempt to gain unauthorised access to the platform or its systems;
- interfere with the operation or security of the service;
- introduce malicious code, malware or other harmful material;
- abuse, overload or attempt to disrupt the platform;
- infringe the intellectual property or other rights of eShopFoundry or third parties.
6. User Content
During the beta, you may be able to upload or submit content, including product information, images, text or other materials ("User Content").
You retain ownership of your User Content.
By submitting User Content, you grant eShopFoundry a limited, non-exclusive licence to host, store, reproduce, process and modify that content only to the extent reasonably necessary to operate, test, maintain and improve the beta.
You represent that you have the necessary rights and permissions to submit the User Content.
You must not upload content that:
- infringes copyright, trademarks, privacy rights or other third-party rights;
- is unlawful;
- contains malicious software;
- is misleading or fraudulent;
- violates applicable laws or regulations.
7. Artificial Intelligence
Certain eShopFoundry features may use artificial intelligence to generate, analyse, modify or transform content.
AI-generated results may contain errors, inaccuracies or inappropriate results.
You are responsible for reviewing AI-generated content before publishing, distributing or using it commercially.
eShopFoundry does not guarantee that AI-generated content will be accurate, unique, suitable for a particular purpose or free from third-party rights issues.
8. Intellectual Property
The eShopFoundry website, software, interface, branding, logos, designs, documentation and other materials provided by eShopFoundry are owned by or licensed to eShopFoundry unless otherwise stated.
Nothing in these Terms transfers ownership of eShopFoundry's intellectual property to you.
You may not copy, reproduce, distribute, modify, reverse engineer or commercially exploit eShopFoundry's proprietary materials except where permitted by law or expressly authorised by us.
9. Feedback
If you voluntarily provide suggestions, comments, bug reports or other feedback about eShopFoundry, we may use that feedback to develop and improve the product.
Where possible, we may use feedback in aggregated or anonymised form.
You will not receive compensation for feedback unless we expressly agree otherwise.
10. Availability
We aim to keep the website and beta available, but we do not guarantee uninterrupted or error-free operation.
The website or beta may be unavailable because of maintenance, updates, technical problems, third-party services or other circumstances.
11. No Guarantee of Results
eShopFoundry does not guarantee that using the platform will result in:
- sales;
- customers;
- revenue;
- profit;
- social media engagement;
- advertising performance;
- business growth.
Any examples, demonstrations or statements concerning potential business outcomes are illustrative and should not be understood as guarantees.
12. Limitation of Liability
To the extent permitted by applicable law, eShopFoundry shall not be responsible for losses arising solely from the experimental nature of the beta, temporary unavailability, technical errors or the use of AI-generated content.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
13. Suspension or Termination
We may suspend or terminate your access to the beta where reasonably necessary, including if you violate these Terms or use the service in a way that may harm eShopFoundry, other users or third parties.
You may stop participating in the beta at any time.
14. Changes to These Terms
We may update these Terms as eShopFoundry develops.
The latest version will be published on this page.
Material changes will be communicated where required by applicable law.
15. Governing Law
These Terms are governed by the laws applicable to eShopFoundry and its operator, subject to any mandatory consumer protection rules that may apply.
Nothing in these Terms limits rights that cannot legally be excluded or waived.
